1. Introduction & Agreement
Welcome to Smokeboxx Cafe ("we", "us", "our"). These Terms and Conditions govern your use of our website and online ordering platform at smokeboxx.co.uk (the "Site"), including the placing of food orders for delivery or collection.
By accessing the Site, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions in full. If you do not agree with any part of these terms, you must not use the Site.
We reserve the right to update these terms at any time. Continued use of the Site following any changes constitutes acceptance of the revised terms.
2. Definitions
- "Customer", "you", "your" — any individual who accesses the Site or places an order through it.
- "Order" — a request submitted by you through the Site for food and/or drink items to be prepared by Smokeboxx Cafe.
- "Delivery" — the transportation of your Order to a specified address within our delivery area.
- "Collection" — the picking up of your Order in person from our premises at 3 Coalway Rd, Wolverhampton WV3 7LR.
- "Account" — a registered user profile on the Site, required to place orders.
- "Loyalty Points" — reward points earned and redeemed through the Smokeboxx Rewards programme.
- "Site" — the Smokeboxx Cafe website and online ordering platform.
3. Account Registration
To place an order, you must create an Account by providing accurate and complete information, including your name, email address, phone number, and delivery address (if applicable).
You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activity that occurs under your account.
- Ensuring that the information held on your account remains accurate and up to date.
We reserve the right to suspend or terminate any account that we reasonably believe has been used in breach of these Terms, including but not limited to fraudulent activity or misuse of promotional offers.
You must be at least 16 years of age to create an account and place orders on the Site.
4. Ordering & Payment
All orders placed through the Site are subject to acceptance by us. We may refuse or cancel an order at our discretion, for example if an item is unavailable, if there is a pricing error, or if we are unable to verify your payment.
When you place an order, you are making an offer to purchase. A binding contract is formed only when we confirm acceptance of your order (typically by email or on-screen confirmation).
Pricing: All prices displayed on the Site are in pounds sterling (GBP) and include VAT where applicable. We make every effort to ensure pricing is accurate, but errors may occasionally occur. If we discover a pricing error, we will notify you and give you the option to proceed at the correct price or cancel your order.
Payment: Payments are processed securely through Stripe. We do not store your full card details on our servers. By submitting your payment, you confirm that the payment method used is yours or that you have authorisation to use it. All transactions are subject to Stripe's own terms of service.
Delivery & Collection: At checkout you may choose either delivery to an eligible address or collection from our premises. Delivery fees, where applicable, will be displayed clearly before you confirm your order.
Our ordering hours are daily from 5:00 PM to 10:00 PM. Orders placed outside of these hours will not be accepted.
5. Delivery
We offer delivery to addresses within our delivery area, covering Wolverhampton and selected surrounding areas. If your address falls outside our delivery zone, you will be notified during checkout and may opt for collection instead.
Estimated Delivery Times: Delivery times provided at checkout are estimates only and are not guaranteed. Typical delivery times range from 30 to 60 minutes depending on order volume, distance, and other factors. We will make reasonable efforts to deliver your order promptly.
Delivery Fees: A delivery fee may apply depending on your location. The applicable fee will be displayed at checkout before you complete your order.
Failed Deliveries: If a delivery cannot be completed because no one is available at the delivery address, or because the address provided is incorrect or incomplete, we are not obligated to redeliver or issue a refund. Please ensure your contact details and address are accurate when ordering.
Risk: Ownership of and risk in the products passes to you upon delivery to the address specified in your order, or upon collection from our premises.
6. Cancellations & Refunds
Due to the perishable nature of food products and food hygiene regulations, you do not have a right to cancel an order once preparation has begun. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, perishable and sealed goods made to specification are exempt from the 14-day cooling-off period.
Cancellation before preparation: If you wish to cancel an order before it has been prepared, please contact us immediately on 01902 535677. We will do our best to accommodate your request, but cancellation is not guaranteed once an order has been submitted.
Refunds: Refunds are issued at our sole discretion. You may be eligible for a full or partial refund in the following circumstances:
- You received the wrong order or items were missing.
- The food was not of satisfactory quality or was substantially different from its description on the Site.
- Your order was not delivered and we were at fault.
To request a refund, please contact us at [email protected] or call 01902 535677 within 24 hours of receiving your order. We may require photographic evidence or other information to process your claim.
Approved refunds will be credited to your original payment method via Stripe. Please allow up to 10 working days for the refund to appear on your statement.
Returns: Due to food hygiene and safety regulations, we cannot accept the return of food products under any circumstances.
7. Loyalty Programme
Smokeboxx Rewards is our loyalty programme, available to all registered account holders.
Earning Points: You earn loyalty points on qualifying orders placed through the Site. The number of points earned is based on the order total (excluding delivery fees and any discounts). The current earn rate and any bonus point promotions will be displayed on the Site.
Redeeming Points: Accumulated points may be redeemed for free menu items or discounts on future orders, as detailed on the Site. Minimum redemption thresholds may apply.
Points Expiry: Loyalty points expire 12 months after the date they were earned if no qualifying order is placed within that period. We will make reasonable efforts to notify you before your points expire, but it is your responsibility to use them within the validity period.
General Conditions:
- Loyalty points have no cash value and cannot be transferred, sold, or exchanged for cash.
- Points cannot be earned on orders paid for (in full or in part) with redeemed points.
- We reserve the right to modify, suspend, or discontinue the Smokeboxx Rewards programme at any time, with reasonable notice provided on the Site.
- Any abuse or manipulation of the loyalty programme may result in forfeiture of points and/or account suspension.
8. Allergen Information
Our food is prepared in a kitchen that handles the following major allergens:
- Celery
- Cereals containing gluten (wheat, rye, barley, oats)
- Crustaceans
- Eggs
- Fish
- Lupin
- Milk
- Molluscs
- Mustard
- Nuts (including peanuts and tree nuts)
- Sesame
- Soya
- Sulphur dioxide and sulphites
While we take reasonable care to prevent cross-contamination, we cannot guarantee that any menu item is completely free from allergens. If you have a food allergy or intolerance, it is your responsibility to inform us before placing your order.

We accept no liability for any adverse reaction arising from food consumed where the customer has failed to notify us of a known allergy or intolerance.
9. Intellectual Property
All content on the Site, including but not limited to text, images, graphics, logos, icons, photographs, menu descriptions, and the underlying software, is the property of Smokeboxx Cafe or its licensors and is protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content from the Site without our prior written consent, except for personal, non-commercial use in connection with placing orders.
The Smokeboxx name, logo, and all related marks are trademarks of Smokeboxx Cafe. Unauthorised use of any of our trademarks is strictly prohibited.
10. Limitation of Liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be lawfully excluded or limited under English law.
Subject to the above, to the fullest extent permitted by law:
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Site or any order placed.
- Our total liability to you for any claim arising from or related to an order shall not exceed the total amount you paid for that specific order.
- We are not liable for any delay or failure in delivery caused by circumstances beyond our reasonable control, including but not limited to severe weather, road closures, vehicle breakdown, or staff shortages.
- We make no warranties that the Site will be available at all times, uninterrupted, or free from errors.
Your statutory rights as a consumer under the Consumer Rights Act 2015 are not affected by these Terms.
11. Changes to Terms
We may revise these Terms and Conditions from time to time to reflect changes in our services, legal requirements, or business practices. The updated terms will be posted on this page with a revised "Last updated" date.
Where changes are significant, we will make reasonable efforts to notify you by email or through a notice on the Site. Your continued use of the Site after any changes have been posted constitutes your acceptance of the revised terms.

12. Governing Law
These Terms and Conditions, and any disputes arising out of or in connection with them (including non-contractual disputes), shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising from these Terms, although we retain the right to bring proceedings against you in the courts of the country of your residence.
If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.
